THE 2007 COSMOGIRL! TAKE ACTION HOLLYWOOD FILM CONTEST OFFICIAL RULES. NO PURCHASE NECESSARY TO ENTER OR WIN. Void where prohibited. The CosmoGIRL! Take Action Hollywood Film Contest ("The Contest") begins on October 17, 2006, and ends on February 1, 2007.
Eligibility: Open only to U.S. residents (excluding residents of Puerto Rico and Guam) who are between 14 and 24 years of age at the time of entry. Employees of CosmoGIRL!, Hearst Communications, Inc., Take Action Hollywood ("TAH") (collectively "Sponsors"), and each of their respective parent, affiliates, subsidiaries, and advertising or promotional agencies, their immediate family members, and any persons domiciled with such employees, are not eligible.
How to enter: First, select a social issue to use as the topic for your film ("Film"). The social issue you select can be one that affects your school, your community, the nation, or the world. Your film must be under 10 minutes and can be a narrative (in scripted form with actors) or documentary (real-life footage). Your entry must include the following three parts: (1) Your film in DVD format. Any other format will not be accepted. (2) A typed or word-processed cover sheet containing the following: The name of your film, your name and date of birth, and the names and dates of birth of any other person(s) who helped you direct or produce the film, your complete address, zip code, and phone number with area code. Please also include your e-mail address if you have one. (3) A typed or word-processed essay ("Essay") of no more than 300 words describing the social cause addressed in your film and why you were inspired to make this film. Mail your completed entry to: CG! Take Action Hollywood Film Contest, 300 West 57th Street, 20th Floor, New York, NY 10019. All entries must be postmarked by February 1, 2007 and received by February 6, 2007. Submissions must be original, unpublished, created solely by the Entrant(s), and predominantly written and spoken in English. All entry submissions must not infringe on any third party rights and if applicable, entrant has obtained permission from anyone who helped direct or produce the film, including a representation from the person(s) that their contribution to the film does not violate third party rights. Please note that if you are under 18, you must have your parent’s or legal guardian's consent to enter the contest and grant sponsors the rights you grant in these rules. Sponsors shall have the right to edit and publish all entries as Sponsors deem fit and may publish and republish in whole or in part in all media now known or hereafter devised in perpetuity without additional compensation. Entries will not be acknowledged or returned. Only one (1) entry per person. Illegible entries are void. Submission of an Entry further constitutes the Entrant's consent or in the case of a minor, the parent's or legal guardian's consent, to irrevocably assign and transfer to Sponsors any and all rights, title, and interests in Entry, including, without limitation, all copyrights, and to use Entrants' names, hometowns, and likenesses and biographies without further compensation, for advertising or publicity purposes (except where prohibited by law). This is not an application for employment.
Judging: Preliminary round: On or about February 8, 2007, ten (10) finalists will be chosen on a rolling basis by employees of CosmoGIRL! based on the following equally weighted criteria: creativity and power of message (the "Criteri"). If Sponsors receive fewer than 10 acceptable entries, Sponsors reserve the right to select fewer than 10 finalists or terminate the contest. Second round: On or about February 22, 2007, the name of each finalist selected, along with their Film and Essay, will be posted on cosmogirl.com, where visitors will be able to view the films and vote for the Winner. Each cosmogirl.com user may vote only once a day. On or about February 28, 2007, the voting will cease and the top three finalists who receive the most votes will enter round three. Third round: A panel of judges will then select the Winner based on creativity (50 percent) and the power of the message (50 percent). If there is a tie, the Judges will select the Winner based on the creativity of the tied Entrants' Submissions. Winner will be notified on or about March 1, 2007.The Winner will be required as a condition of eligibility to complete and sign or if she is a minor, have her parent or legal guardian sign, an Affidavit of Eligibility, Waiver of Liability, and Publicity Release ("Contest Documents") and return forms to CosmoGIRL! within seven days of being notified that she has won. If for any reason Winner does not meet the above eligibility requirements or does not comply with any term or condition of these Official Rules, including the timely return of the Contest Documents, in Take Action Hollywood's or CosmoGIRL!'s sole discretion, the Judges may select an alternate Winner. The decisions of the Judges are final and Entrants agree to be bound by these decisions.
Grand prize: Subject to eligibility and compliance with these Official Rules, the Grand Prize Winner, or her or his parent or legal guardian ("Grand Prize Winner"), or if the Winner is a minor, the Winner's parent or legal guardian, will be awarded the following Grand Prize:The Winner will receive a $10,000 grant from Take Action Hollywood; the Winner's Film will be shown on cosmogirl.com and takeactionhollywood.com; the Winner will be featured in an upcoming CosmoGIRL! issue, details of which are to be determined at CosmoGIRL!’s sole discretion.
Taxes: All taxes and other expenses and incidentals not specified herein are the sole responsibility of the Winner.
General conditions and releases: (1) By entering, you agree to be featured in CosmoGIRL! magazine. (2) By entering you agree (except where prohibited by law) that Sponsors may use your name, city, state, likeness, appearance, and voice in connection with this Contest and its promotion without any additional compensation. (3) Except where prohibited by law, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsors in connection with the Contests, shall be governed by, and construed in accordance with, the laws of the state of New York, without giving effect to any choice of law or conflict of law rules (whether the state of New York or any other jurisdiction) which would cause the application of the laws of any jurisdiction other than the state of New York. If any controversy or claim arising out of or relating to the Official Rules, or the breach of any term hereof, cannot be otherwise resolved, it shall be resolved by binding arbitration conducted in the County of New York and administered by JAMS in accordance with its Streamlined arbitration Rules and Procedures or subsequent versions thereof (the "JAMS Rules"). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be an experienced arbitrator licensed to practice law in New York. (4) No substitution, transfer, or cash equivalent for prize (or prize components) except that Sponsors may substitute a prize (or prize component) of equal or lesser value for any reason.
Disclaimer: All Entrants assume all liability for any injury or damages caused or claimed to be caused by their participation in this contest. ALL NOMINEES RELEASE TAKE ACTION HOLLYWOOD AND COSMOGIRL! AND THEIR RESPECTIVE ADVERTISING AND PROMOTION AGENCIES, THEIR PARENT, SUBSIDIARIES, AND JOINT VENTURE COMPANIES, AS WELL AS THEIR RESPECTIVE OFFICERS, DIRECTORS, AND EMPLOYEES, FROM ANY SUCH LIABILITY.
Sponsors, or their respective advertising and promotion agencies, their parent, subsidiary, and joint venture companies, as well as their respective officers, directors, and employees assume no responsibility for any injury (including but not limited to any personal injury), damage, or losses of any kind to any Entrant, or to any Entrant's or other person's computer, relating to or resulting from participating in this contest. The Sponsors and their respective advertising and promotion agencies, their parent, subsidiary, and joint venture companies, as well as their respective officers, directors, and employees are not responsible for mail-in entries that are illegible, incomplete, late, lost, or postage due, nor for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this event or by any human error which may occur in the processing of the entries in this event. If for any reason the Competition is not capable of running as originally planned, or if infection by a computer (or similar) virus, bugs, tampering, unauthorized intervention, actions by Entrants, fraud, technical failures, or any other causes, in the sole opinion of Sponsors corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Competition, Sponsors reserve the right, in its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, extend, modify, or suspend the Competition, and select the Winner from all eligible entries received. Sponsors reserve the right to terminate the entry period prior to its scheduled end date and to choose among entries received prior to the date of such termination.
